California Risks Funds in Sanctuary City Fight Against Trump Administration

California Attorney General Xavier Becerra is launching a preemptive legal assault against the Trump administration’s promise to pull tens of billions of dollars of federal funding from “sanctuary cities” that do not cooperate in enforcement against illegal aliens.

Attorney General Xavier Becerra is leading a coalition of 300 cities, 18 counties, and the State of California that intend to sue the Trump administration over U.S. Attorney General Jeff Sessions’s plan to begin cutting off funding to jurisdictions tagged by the U.S. Justice Department as “sanctuary cities,” which harbor illegal aliens from Immigration and Customs Enforcement (ICE) agents, according to the Sacramento Bee.

But President Trump is seeking to withhold funds from sanctuary cities through executive orders that his administration is defending in court. And that is only the beginning.

The Republican-controlled House of Representatives recently passed Kate’s Law, which would increase maximum penalties for criminal aliens who attempt to re-enter the country, and H.R. 3003, which would cut funding to sanctuary cities that refuse to cooperate with federal immigration laws.

With the U.S. Senate expected to soon pass similar legislation for President Trump’s signature, California Democrats understand that significant funding is at risk of being suspended over issues associated with sanctuary cities.

The breakdown of California’s federal funding, by department, includes: 52 percent for Health and Human Services (Medicaid); an average of 25 percent of all state and local government general revenues for Labor and Workforce Development; 14 percent for Education; 6 percent for Transportation; 2 percent for Legislative, Judicial and Executive; and 1 percent for General Government, which includes Natural Resources, Environmental Protection, Corrections and Rehabilitation, State and Consumer Services.

In an added risk to Democrats, Breitbart California editor Joel Pollak reported on August 5th that Judicial Watch just wrote a letter to California Secretary of State Alex Padilla questioning why 11 of California’s 58 counties appear to be in violation of the National Voter Registration Act by having more registered voters than adults over the age of 18.

California Governor Jerry Brown appointed Becerra as Attorney General in January, replacing Sen. Kamala Harris (D-CA).

A plan of action
In recognition that 2 chances of success are twice as good as one this plan is offered for your
consideration. This plan is acknowledged to have a 5-10% chance of success, but I believe is worth
pursuing in part because it also may open up other opportunities that are unforeseen at the moment.
Historically previous state splits have occurred during periods of constitutional crisis, one impending
crisis is the bankruptcy of several states including California. For example West Virginia was split
(unconstitutionally) from Virginia during the civil war. Prior to 1860 the big issue was slavery, and
second debts. Maine came in and was separated from Massachusetts to create a new free state as
another slave state came into the union.
In 2011 Gov Brown, while in attendance at the council of governors meeting, was informed that if
California declared bankruptcy the 31 red states in the center of the country would secede from the
union! Now here’s a constitutional crisis in spades and such a warning would not have been issued if the
bankruptcy of California was an unlikely possibility.
Currently there is no formal bankruptcy process for states, as there is for cities and counties. However
with Puerto Rico defaulting on its bond payments last week, even though PR is a US territory and not a
state, the issue is being addressed in congress. Currently there is an impasse between the parties where
the Democrats want a financial bailout and the Republicans want a more of a formal receivership where
instead of a trustee, a territorial governor is appointed to reorganize the debt of the formerly sovereign
state.
The goal of this plan is to have SOJ in position to be a viable, responsible and functioning government in
Northern California in the event this happens.
1. Create a provisional government/standing committee that represents all the 23 counties of
Jefferson with a single voice.
2. Through that voice we issue frequent press releases and opinion papers with our position on
proposed California legislation and problems past legislation has caused.
3. Establish ambassadors to form working relationships with the “red” state governors.
4. Organize volunteer legal teams and work with existing foundations with areas of expertise
needed to promote our cause.
5. Support the frequent defense of liberty court cases the red states are bringing via friends of
the court amicus briefs.
6. Develop a productive working relationship with the Federalist Society whose members
include many of the red state governors and Supreme Court Justices. Former Justice Antonin
Scalia was a high profile Federalist Society member.
